According to article - 167, if two-third member of Legislative Assembly give assent for the establishment of Legislative Council, then Parliament establish a separate house(Legislative Council) for that State.

The total strength of Legislative Assembly of Bihar is 243, out of which 242 are elected by the people of Bihar and one is appointed by the Governor of Bihar.
According to article - 170, the number of members in Legislative Assembly of any State should not be more than 500 members and not less than 60 members.

The qualification to be member of Bihar Legislative Assembly?
1. He should be citizen of India.
2. He should be not less than 25 years of age for Legislative Assembly and not less than 30     years for Legislative Council.
3. No person can become a member of the Legislative Assembly or the Legislative Council       of any state, unless he himself is a voter from any constituency of the state.

What is the tenure of Bihar Legislative Assembly?
The tenure of all State Legislative Assembly is 5 years. But article - 370 gives special status to Jammu & Kashmir State legislature. The tenure of Legislative Assembly of Jammu & Kashmir is 6 years.

1/3 of the total members of the Council is elected by local bodies such as municipalities, district boards, etc.
1/3 is elected by members of the Legislative Assembly from amongst persons who are not members of the Assembly.
1/12 is elected by graduates of three years' standing residing in the State.
